| Why do I need a lawyer? Because Social Security is a very complex set of rules and regulations and the system is so clogged with paperwork and so backlogged, that disability determination workers cannot keep up. Administrative agency personnel are not your advocate and do not explain your legal options. A lawyer can marshall the medical information and get it in the file. These claims are based on your functional limitations not just your medical treatment- depression, stress, and even pain are becoming ever more important in determining disability. You need a lawyer who knows these legal issues and how your claim will be decided by the Judge. There is a science and an art in focusing the evidence in these cases. I work with your doctors to render reports that describe your medical condition properly. I use forms and methods of my own design to get evidence for your case. In some cases I can get an earlier onset date and more back pay. Claimants with knowledgeable lawyers are approved at a much higher rate than those who go it alone. ALERT: If you have received a denial letter, you have only 60 days to ask for a review. Make sure you request one. Your denial letter tells you how to appeal-it's easy. About 70% of claims are denied at first-over half of the people who appeal, win their case. The fee is limited by law and generally is only 25% of the lump sum check for past due benefits or $5300, whichever is less. There is never a fee from your monthly check and never a fee unless we win. The fee is deducted before a check is cut for the claimants' back due benefits. A typical lum sum payment to the claimant for back due benefits would be about $18,000. Then the claimant gets a monthly payment, usually for the rest of their life, in addition to other benefits. What are the "costs and expenses, I might have to pay?" In most all cases there are no costs and expenses the client has to pay. An example would be if we have to pay a physician to render a report or testify- this is very rare.
